When you engage in using our Service or reserving a yacht charter, you are agreeing to abide by these Terms. In case of non-agreement with any section of these terms, you should refrain from using the Service.

2. Service Overview

Ocean's Elegance Yacht Club offers exclusive yacht charter services that include, among others:

• Rentals of yachts for a day
• Evening boat trips
• Outings for corporate teams
• Privately organized occasions
• Charters spanning several days

All offered services are dependent on availability and favorable weather conditions. We retain the right to change or cease services anytime.

3. Booking and Reservations

3.1 Booking Process

To secure a yacht charter, you are required to:

• Confirm that you are 18 years old or over
• Deliver accurate and thorough details
• Settle the prescribed deposit as outlined in your booking confirmation
• Consent to these Terms & Conditions

3.2 Confirmation

A charter booking is established only after we receive your payment and send you a written confirmation. We hold the authority to decline service to any person at our sole discretion.

3.3 Availability

Charter availability is dependent on the accessibility of vessels and agreeable weather conditions. We will try our best to accommodate your requested dates and times.

4. Payment Terms

4.1 Pricing

All our prices are stated in € and include all relevant taxes unless stated otherwise. We reserve the right to adjust prices without a prior notice.

4.2 Payment Schedule

• A deposit equating to 50% of the overall charter cost is required during the booking
• The remaining balance: Payable 48 hours before the charter's scheduled departure
• Any other fees (if applicable): Due upon the completion of the charter

4.3 Payment Methods

Possible methods of payment include major credit cards, bank wires, and certified cheques. Our payment processing utilizes secure and encrypted mechanisms.

5. Cancellation and Refund Policy

5.1 Customer Cancellations

• Up until 72 hours before departure: Full reimbursement minus service charges
• Within 72 to 24 hours before departure: Refund of 50%
• Under 24 hours before departure: No reimbursement is afforded

5.2 Weather Cancellations

In case the weather is judged to be unsafe by our captain, we will endeavor to either:

• Reschedule the charter to an alternative date without additional fees
• Issue a complete refund if rescheduling proves impractical

5.3 Mechanical Issues

Should mechanical complications arise with the designated vessel, we will make efforts to arrange an equivalent replacement. A full reimbursement will be provided if an appropriate substitute is unavailable.

6. Safety and Conduct

6.1 Safety Requirements

It's required for all passengers to:

• Heed all instructions from the crew
• Don safety gear when indicated
• Disclose any medical conditions that could influence their safety
• Stay within allocated spaces on the vessel

6.2 Prohibited Items

The following cannot be brought on board:

• Containers made of glass
• Illegal substances
• Weapons or firearms
• Excess amounts of drinks (beyond reasonable consumption)
• Pets (unless they've been pre-approved)

6.3 Conduct

All passengers are to behave in a manner that's respectful. We have the authority to end a charter prematurely without refund if passenger conduct is threatening safety or disturbing other patrons.

7. Liability and Insurance

7.1 Our Liability

We limit our liability to the cost paid for the charter. Our responsibilities do not cover:

• Injuries to individuals that result from their own carelessness
• Loss or destruction of personal belongings
• Indirect, incidental or punitive losses
• Delays attributed to weather or other circumstances that are beyond our influence

7.2 Insurance Coverage

We hold comprehensive maritime insurance that provides coverage for our vessels and operations. Passengers must ensure they are covered by their personal travel and possession insurance.

7.3 Assumption of Risk

By partaking in our yacht services, you're acknowledging that activities on water come with inherent dangers and you're assuming accountability for your safety and security.

8. Modifications and Itinerary Changes

We maintain the right to adjust itineraries, paths, or schedules if needed due to weather conditions, safety reasons, or operational needs. We will make a concerted effort to provide alternatives of comparable value.

9. Force Majeure

We're not accountable for any alterations, delays, or cancellations brought by unforeseeable forces beyond our management, including but not confined to:

• Extreme weather events
• Natural catastrophes
• Governance regulations
• Port shutdowns
• Vessel malfunctions

10. Privacy and Data Protection

Your private data is managed in line with our Privacy Policy. Utilizing our services expresses your consent to our data collection and use as elaborated in our Privacy Policy.

11. Intellectual Property

Every element on our website, such as text, images, logos, and graphics is guarded by copyright and trademark laws. You may not duplicate, distribute, or generate derivative creations without our express permission.

12. Governing Law

These Terms are administered by the laws of Germany. Conflicts will be resolved in the courts of Hamburg, Germany.
